Terms of service

These Terms of Service ("Terms") govern your access to and use of ByFeed – Product Feed Manager ("ByFeed", "the Service") provided by ByBelt ("we", "us", or "our") at byfeed.bybelt.com. By installing, accessing, or using ByFeed, you agree to these Terms.

If you are using ByFeed on behalf of a company, you represent that you have authority to bind that company to these Terms.

1. The Service

ByFeed helps Shopify merchants create, validate, schedule, and publish product feed files for third-party channels such as Google Merchant Center, Meta Catalog, TikTok Shop, and Pinterest. Features and limits depend on your subscription plan. We may update, improve, or discontinue features with reasonable notice where practicable.

2. Eligibility and Shopify account

You must have a valid Shopify store and comply with Shopify's terms and policies. You are responsible for maintaining the security of your Shopify account and for all activity under your store.

3. Permissions and your data

ByFeed requests read-only access to your Shopify products (read_products) to generate exports. You retain ownership of your catalog and content. You grant us a limited license to access, process, store, and transmit your data solely to provide the Service, as described in our Privacy Policy.

You represent that you have all rights necessary to export and share product data with the channels you configure, including images, trademarks, and product claims.

4. Subscriptions and billing

Paid plans are billed through Shopify's app billing system. Fees, billing cycles, and plan limits are shown in the app and on our website. Charges are non-refundable except where required by law or Shopify policy. You may upgrade, downgrade, or cancel through the app; cancellation stops future charges but does not retroactively refund prior periods.

Free and trial features may change. We may modify pricing with notice; continued use after a price change constitutes acceptance unless you cancel.

5. Acceptable use

You agree not to:

• Use ByFeed for unlawful, fraudulent, or misleading product listings
• Attempt to reverse engineer, scrape, or overload the Service
• Circumvent plan limits, security controls, or access restrictions
• Upload or generate content that infringes third-party rights
• Resell or sublicense the Service without our written consent

We may suspend or terminate access if we reasonably believe you violated these Terms or pose a security or legal risk.

6. Third-party channels

ByFeed generates files and URLs for platforms we do not control. You are responsible for complying with each channel's policies, account setup, and approval processes. We do not guarantee acceptance, ranking, ad delivery, or sales on any third-party platform.

7. Feed URLs and availability

We strive to keep feed generation and public URLs available, but the Service is provided on an "as available" basis. Scheduled maintenance, Shopify API limits, or infrastructure events may cause delays. You should monitor feed health using in-app diagnostics.

8. Intellectual property

ByFeed, its software, branding, documentation, and website content are owned byByBelt or its licensors and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks except as needed to use the Service as intended.

9. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT FEEDS WILL BE ERROR-FREE, UNINTERRUPTED, OR MEET EVERY CHANNEL REQUIREMENT WITHOUT YOUR REVIEW.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ByBelt AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR BYFEED IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) USD $100.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

11. Indemnification

You will defend and indemnify ByBelt against claims, damages, and expenses (including reasonable legal fees) arising from your catalog content, your use of the Service, your violation of these Terms, or your violation of third-party rights or channel policies.

12. Term and termination

These Terms remain in effect while you use ByFeed. You may stop using the Service by uninstalling the app from Shopify. We may suspend or terminate access for breach, risk, or discontinuation of the Service. Sections that by nature should survive termination will survive (including payment obligations, disclaimers, limitations, and indemnity).

13. Changes

We may update these Terms from time to time. We will post the revised Terms on this page and update the "Last updated" date. Material changes may be communicated through the app. Continued use after changes become effective constitutes acceptance.

14. Governing law

These Terms are governed by the laws applicable in the jurisdiction where ByBelt is established, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country provide otherwise.
